Commission Issues Revised and Restated Rules

     On January 28, 2008 the Commission adopted its Revised and Restated Rules.  The updated Rules may be accessed at www.ncir.ne.gov/rules.  Part of the reason for the revision of the Rules was brought about by LB 472, passed by the Nebraska Legislature on March 1, 2007 and signed by the Governor on March 7, 2008.   This law changed the designation of the members of the Commission from "Judge" to "Commissioner" and this change is reflected throughout the revised Rules.

In addition, several other changes were made.  Briefly, these included the following:

Rule 5A(3) has been added to allow filing electronically.

Rule 8 has been amended to add requirements regarding the date for filing a Petition to Intervene in a representation proceeding.

 Rule 11 has added language regarding the use of the mail-ballot process.

    The Association of Labor Relations Agencies (ALRA) is an association of impartial government agencies in the United States and Canada responsible for administering labor-management relations laws or services.  The association promotes cooperation among these agencies, high professional standards, public interest in labor relations, improved employer-employee relationships, peaceful resolution of employment and labor disputes, and the exchange of information regarding the administration and improvement of agency services including, but not limited to, mediation, conciliation, fact-finding, arbitration or adjudication.

    The Nebraska Commission of Industrial Relations maintains membership in this professional organization, with judges and staff participating in various educational opportunities provided by ALRA, including the annual conference.
